Dear Sir, I am Cinar ,General Manager at Shanghai Phaselis Investment Consulting Co., Ltd.I have some problems with a Xiamen Trade company and would like to get some information and go on for further notices with you.So we made an agreement with Xiamen Goldencome Import and Export Company on the 23 rd of April,2007 for buying 2018 cbm Medium Density Fiberboard and in our contracts was everythings are clear about shipment and payment.according to our contract we had to open L/C and sent cash % 30 payment.At the same time we could open L/C and sent them % 25 cash payment on the 1 st of May ,2007 because of the rules are changed by Iran trade ministery for that reason we could sent % 25 cash.For that chinese labour Holiday they told us they couldnt see L/C and cash payment till 11 May.But after opening L/C and sending cash money we have sent them the bank documents.And on the 12 nd of May they told us that they coudlnt accept the L/C and wanted to cancel and they asked to us for % 100 payment cash money for 2083 cubicmeter MDF.Totaly it was 447974 Euro and we told them we could sent % 30 cash and the balance before shipment after inspection.So we both agreed to change payment style to TT.On the 15 th of May we have sent them totaly 130.000 USD and we wanted to sent again 100.000 USD .But they told us that we could wait first before sending money.So we waited and asked many times to sent money.According to our agreements they would ship at the end of May 10 containers but this item we dont have in our contract.Just we agreed per e mail and I have all e mails and etc from them.So they didnt ship 10 conteiners.They have shipped only 2 containers on the 2nd of June.But we didnt get any shipment documents from them.They told us that they have shipped.But no documents and we didnt get any products from them till now.Normaly it takes 16 -17 days from China to iran to deliver the goods.Till now no goods.And In our contract writes that they will ship totaly 2083 CBM after receiving the deposit.We have sent them 130.000 usd deposit on the 15 th of May.And till now we dint get any goods of them.We asked for the goods and they told us in the on the 4 th of June they want to cancel the contract.We also agreed but we asked for our 130.000 usd money.They told us that they can not get back from the manufacturer.Today is 25 June .And in our contract writes late shipment rules.every 7 days will be punished % 0.5 penalty.So we asked them for our money last week again they told us they would like to ship and today they informed us that they dont want to ship and sent us our money back.With this Xiamen Goldencome Import and Export Company we have lost our money and we have wasted our time for 2 months long.We asked government and no answer till now.We dont want to waste time with china laws because of if we claim them we will waste again time and at least 2-3 months.We want to get our goods for 130.000 usd and want to have the late shipment payments.Could you pls help us about it and how can we do it together with you?
